Terms and Conditions of Service Provision
Our aim is to keep the ‘boring business stuff’ as simple and straightforward as possible, and focus maximum effort on providing a high level of support to our clients.
However – in order that both parties are aware of their obligations to each other – we’ve set out a few important Terms and Conditions that explain what you can expect from us and, in return, what we expect from you.
Our intention is always to try to avoid situations that may result in us having to make additional charges for cancellation or rearrangement of services, and wherever possible we will try to accommodate any changes requested of us at no extra charge.
If you do need to make a change to a booking please let us know as quickly as possible. Unfortunately there are a small number of occasions when we are let down without adequate reason or notice, and it is only in these instances that we will seek to recover the advance costs we may have incurred or recoup lost diary time that cannot be reallocated.
If you would like further explanation or clarification of any of the Terms and Conditions detailed below please don’t hesitate to let us know. This is important, as all services we provide are subject to these Terms and Conditions, and by confirming a booking with us you agree to be bound by them.
1. Definitions
In these Terms and Conditions all references to “we”, “us”, “our” and “the assessor” refer to Dyslexia Lincs, and all references to “you”, “your”, “the client” and “the parent” refer to the client booking and paying for a service to be provided.
References to the “student”, “pupil” or “child” refer to the individual to whom a service is provided.
References to “service” or “services” refer to the various services provided by Dyslexia Lincs as detailed on website www.dyslexialincs.co.uk.
References to “Terms and Conditions” refers exclusively to these Terms and Conditions in entirety.
2. Booking
Bookings for services can be made by telephone or via email. We will confirm a booking to you in writing via email [where an email address is provided].
All bookings are accepted on the basis that you agree in full to these Terms and Conditions [including any variations that may be made from time to time] and agree to be bound by them.
2a. Booking – Assessment
Depending on assessor availability, assessment bookings are usually made several months in advance of the date on which the assessment is due to be carried out, to allow for parent and school questionnaires to be completed and returned prior to the assessment.
2b. Booking – Screening Test
Depending on assessor availability, screening test bookings are usually made several weeks prior to the date on which the test is due to be carried out. There are no questionnaires or other forms to be completed prior to testing.
2c. Booking – Specialist Tuition
Specialist tuition can be booked in either four, eight or twelve-session blocks, with a corresponding level of discount available.
Sessions will run consecutively, with an interval of no more than one week between sessions booked as a block [e.g. we cannot accept bookings for ‘every other week’ or similar arrangement].
Please note that a booking is provisional until payment is received. Payment must be received within 24 hours of a booking being made, otherwise the provisional date/time slot will be released and may be reallocated.
3. Rearrangement/Cancellation
3a. Rearrangement/Cancellation – Assessment
Assessments require considerable advance preparation and allocation of diary time, and rearrangement – particularly at short notice – can be difficult. However, we recognise that sometimes this cannot be avoided [i.e. in the case of sudden illness, etc.] and we will always endeavour to work with you to arrange an alternative date/time where necessary.
If an assessment has been rearranged once and a further rearrangement is subsequently requested and agreed, we reserve the right to charge an additional fee of £150.00 to cover the cost of wasted diary time, etc.
If an assessment is booked and confirmed but subsequently cancelled [not rearranged], or if an assessee does not attend for the assessment on the confirmed date/time without providing adequate notice, the advance payment [50% of the total assessment fee] will be retained to cover the cost of advance work undertaken [consultation, preparation of questionnaires, etc.] and wasted diary time.
If cancellation of an assessment is required due to unavailability of the assessor for whatever reason, we will endeavour to provide as much notice as possible. In this event the assessment will be rescheduled for a mutually convenient alternative date.
3b. Rearrangement/Cancellation – Screening Test
Screening tests require some advance preparation and allocation of diary time, and rearrangement – particularly at short notice – can be difficult. However, we recognise that sometimes this cannot be avoided [i.e. in the case of sudden illness, etc.] and we will always endeavour to work with you to arrange an alternative date/time where necessary.
If a screening test has been rearranged once and a further rearrangement is subsequently requested and agreed, we reserve the right to charge an additional fee of £50.00 to cover the cost of wasted diary time, etc.
If a screening test is booked and confirmed but subsequently cancelled [not rearranged], or if a testee does not attend for the screening test on the confirmed date/time without providing adequate notice, 50% of the screening test fee will be retained to cover the cost of advance work undertaken and wasted diary time.
If cancellation of a screening test is required due to unavailability of the assessor for whatever reason, we will endeavour to provide as much notice as possible. In this event the screening test will be rescheduled for a mutually convenient alternative date.
3c. Rearrangement/Cancellation – Specialist Tuition
We recognise that sometimes it may be necessary to postpone a session at short notice due to illness or other unavoidable situation. In such cases we will work with you to rearrange a mutually convenient alternative date/time [later the same week if possible]. We would kindly request that as much notice as possible is provided if a scheduled session cannot be attended.
We will be happy to rearrange one session per block booking at no extra charge, but reserve the right to make an additional charge equivalent to 25% of the cost of one session if a second session is rearranged within a block booking, and 50% of the cost of one session for each subsequent rearranged session within a block booking.
If rearrangement of a tuition session or sessions is necessary due to unavailability of the tutor for whatever reason, we will endeavour to provide as much notice as possible. In this event the session[s] will be rescheduled for a mutually convenient alternative date/time, usually later the same week.
4. Payment
Payment can be made by bank transfer [BACS]. Bank details will be provided when a booking is made.
4a. Payment – Assessment
50% of the assessment fee is required to be paid at the time of booking, with the remaining 50% due on the day [or first day, in the case of a split session] that the assessment is carried out. Please note that no written reports or other materials will be released until payment in full has been received.
4b. Payment – Screening Test
Full payment of the screening test fee is required to be made at the time of booking.
4c. Payment – Specialist Tuition
Full payment for specialist tuition session blocks is required to be made at the time of booking.
5. Additional Conditions of Assessment
We reserve the right not to accept an assessment booking, to terminate an assessment, or not to circulate an assessment report if:
5a. the referral appears to be outside the assessor’s area of expertise;
5b. the client and/or student fails to co-operate fully with the requirements of the assessment procedure in such a way that may compromise the validity of the assessment.
In the case of 5a. any advance fees already paid will be refunded in full. In the case of 5b. any advance fees already paid will not be refunded, and the full assessment fee may be requested to be paid.
6. Fees
The current fees for services offered by us are as published on the website www.dyslexialincs.co.uk.
We reserve the right to amend fees at any time and without prior notice.
7. Behaviour
The student must behave responsibly at all times, and co-operate with the assessment, screening test or tuition being provided. We reserve the right to terminate an assessment, individual assessment session, screening test or tuition session at any point if a student does not behave in a responsible and co-operative manner. In the case of termination due to unacceptable behaviour no refund of fees will be made.
8. Damage
You accept full liability for any damage caused by the student to any premises where an assessment, screening test or specialist tuition is being provided.
9. Termination
Specialist tuition services can be terminated by you or by us at any time by providing notice in writing.
If a block-booking of tuition sessions has been made by you and you subsequently decide to terminate the arrangement prior to the first session being provided, a full refund of the advance payment will be made. If sessions within a block-booked series have already commenced, a refund of 50% of the cost of each remaining session will be provided.
If a block-booking of tuition sessions has been made by you and we subsequently decide to terminate the arrangement, a full refund of any advance payments will be made, unless termination is due to unacceptable behaviour of the student [please refer to clause 7.].
10. Confidentiality
Any assessment report, screening test and associated information is confidential and copies will be made available solely to the client booking the service unless written consent is received requesting provision to a third party [e.g. school, college, etc.]. Similarly, we will not discuss with a third party any aspect of services we provide or have provided to a student without the express written permission of the client.
11. Privacy
We hold and process personal information about clients and students in accordance with our Privacy Policy. Please read our Privacy Policy carefully to understand our use and treatment of personal information. By booking services from us you consent to such processing and agree that all information provided by you is accurate.
12. Limitation of Liability
Whilst we will endeavour to ensure that the student makes satisfactory academic progress, there are obviously many influencing factors beyond our control, and, accordingly, academic progress cannot be guaranteed. We cannot be held accountable for the academic progress or otherwise of the student.
To the maximum extent permitted by law, we accept no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of specialist tuition services provided by us.
We accept no liability for the loss of, or damage to, student’s personal property.
Under no circumstances shall our liability to you exceed the fee paid for a service.
13. Right To Amend
We reserve the right at all times to vary, change, alter, amend, add to or remove any of these Terms and Conditions.
Please ensure that you review these Terms and Conditions each time you book a service from us as, by confirming a booking, you will be deemed to have accepted the Terms and Conditions prevailing on the date of booking.
